Preamble

The www.dressingd.fr website is operated by and is the property of the company DGC, a SARL (limited liability company) with a share capital of €5,000, registered with the Nancy Trade and Companies Register (RCS) under number 102 208 428, operating under the trade name Dressing D and hereinafter referred to as "DRESSING D"

1. Definitions

For the purposes of these Terms of Use (ToU), all of the following capitalized terms shall have the meanings ascribed to them below and apply equally to the singular and the plural:

Customer: Any User who has created an Account to purchase Products or request DRESSING D's services (consignment, firm purchase, free transfer)

Terms of Use (ToU): The Terms of Use made available on the Site. They define and delimit the conditions of use for any person who accesses and uses the Site;

General Consignment Conditions (GCC): Govern the relationship with consignors.

General Conditions of Sale (GCS): Govern the purchase of products

Consignor: Any natural person or legal entity entrusting a Product on consignment, offering a Product for firm purchase, or carrying out a free transfer of a Product to DRESSING D.

Service Provider: DRESSING D, commercial name of the SARL DGC, located at 74 route de Landremont 54380 Bezaumont, registered with the Nancy RCS under number 102 208 428 and owner of the DRESSING D Site;

Site: The DRESSING D website accessible at www.dressingd.fr

User: Any natural person or legal entity accessing the Site;

2. Purpose

These ToU define the rules for accessing the Site and creating an Account.

Acceptance of these ToU is materialized by a checkbox during Account creation. This acceptance is full and complete. For users browsing the Site without an account, simple access implies acknowledgment of the rules of proper usage.

3. Acceptance of the Terms of Use

These Terms of Use apply to all Services provided by the Service Provider on the Site as presented herein.

Acceptance of the ToU occurs at the time of Account creation via a mandatory checkbox. Without this acceptance, creating an Account and accessing the associated Services are impossible.

The ToU can be consulted at any time from the Site. The User accepts that they will not be sent on paper.

In the event that the User does not wish to accept all or part of these ToU, they are requested to refrain from any use of the Services.

Consequently, the User is solely obligated to review the ToU upon their first access and throughout all connections made.

The Service Provider reserves the right to modify these ToU at any time. In the event of modification, the User will be informed by email or by a notice displayed on the Site. Use of the Services after the effective date of the modifications constitutes acceptance of the new ToU. In case of disagreement with the modifications, the User is free to request the closure of their Account free of charge.

4. Description of the Service

The Service Provider is a platform specialized in gymnastics outfits and equipment via:

An online consignment service
A direct sales service

The Service Provider also accepts free transfers of gymnastics outfits and equipment. After expert appraisal, these items are either put back up for sale or transferred/donated to partner organizations depending on their condition.

Product Condition: The Site primarily offers second-hand (used) items. However, the Service Provider may also offer new items (particularly from clearance sales, end-of-line stock, or partner creations).

The condition of each Product is systematically specified on the corresponding product sheet.

Role of the Service Provider: Depending on the nature of the Products, the Service Provider acts either as an agent (on behalf of third-party Consignors) or as a direct seller. In all cases, the Service Provider ensures the selection, physical appraisal, and online listing of the Products.

Appraisal: Each product undergoes a rigorous manual check (condition, compliance, authenticity). The Service Provider systematically rejects any counterfeit items. The appraisal covers the apparent condition of the product upon receipt.

Pricing: The selling price on the Site is set by the Service Provider after appraisal. In the context of consignment, this price is determined in agreement with the Consignor when drawing up the consignment contract. For products from its own stock (firm purchases or free transfers), the Service Provider sets the price freely.

5. Access to the Site

5.1. Terms of Access

The Site is accessible free of charge 24/7 to any User with internet access. All costs related to access (hardware, software, connection) are the sole responsibility of the User. They are solely responsible for the proper functioning of their computer equipment as well as their internet access. The Service Provider implements reasonable means to ensure quality access but is under no obligation of result. Furthermore, the Service Provider cannot be held liable for any network or server malfunction, or any other event beyond its reasonable control that prevents or degrades access to the Service. It reserves the right to interrupt or suspend access for maintenance or updates, without notice or compensation.

5.2. Legal Capacity

Use of the Site is reserved for adults with full legal capacity. Use by a minor is subject to the prior agreement of their legal representatives. By accessing the Site, the User guarantees that they meet these conditions.

5.3. Account Creation

Browsing listings is free and open. However, purchasing and depositing Products require the creation of an Account. The User undertakes to provide accurate information and to maintain the confidentiality of their credentials, for which they are solely responsible.

5.4. User Commitments (Proper Usage)

The User undertakes to use the Site in accordance with its intended purpose (purchasing, selling, and browsing gymnastics items). In particular, they refrain from:

attempting to disrupt the proper functioning of the site (intrusion attempts, introduction of viruses, server overloading)
extracting data in an automated manner (scraping)
using the Services for illicit purposes or purposes contrary to these ToU

5.5. Suspension of the Purchasing Service

The Service Provider reserves the right to temporarily suspend the purchasing function (holidays, inventory, travel). During these periods, products remain visible but no orders can be finalized.

5.6. Sanctions

The Service Provider reserves the right to refuse or remove access to the Service, unilaterally and without prior notice, to any User who fails to comply with these ToU or attempts to harm the platform.

6. Account Creation

6.1. Conditions Related to Account Creation

Account creation is reserved for adult Customers with legal capacity.

The Service Provider reserves the right to verify any registration and request, if necessary, additional documents to validate the information provided.

The Service Provider may refuse a registration that does not meet the platform's criteria.
